CONSERVATIVE PRINCIPLES: LEGISLATION
· The size and scope of the criminal law, especially the Federal criminal law, should be reduced.
· A moratorium on law making should be introduced in all states until old, useless, non-enforced laws and laws that unfairly restrict liberty are eliminated.
· Mandatory and structured sentencing schemes should be abolished. These schemes promised that similar offenders would be treated similarly but they have failed to effectively deal with individual circumstances. Reducing or eliminating these schemes will give some discretion back to judges and will take some away from prosecutors.
· “Hate Crimes” and various other criminal enhancements should be abolished.
· Family Courts should be restructured to prioritize mediation and studies of their operation should be immediately undertaken.
· Child protection should take a greater priority. Child protection efforts should be better funded, child protection works should be better paid, and children from seriously abusive homes should be removed.
· Efforts to use the law to restrict freedom of speech should be eliminated—especially on college campuses.
